At Tank Jowett Solicitors, our specialist criminal defence team recently secured a favourable outcome for a client facing extremely serious allegations of assisting unlawful immigration into the United Kingdom. Cases of this nature are prosecuted robustly by the authorities and carry the real risk of substantial custodial sentences, confiscation proceedings, and long-term reputational damage.

This case involved complex cross-border enforcement action, digital evidence obtained from mobile devices, and detailed analysis of Border Force material. From the outset, we recognised the gravity of the allegations and the potentially life-changing consequences for our client’s liberty, livelihood, and immigration status. Early strategic preparation was essential.

The Allegations: Assisting Unlawful Immigration

Our client was arrested following a stop at the UK border after several Albanian nationals were discovered in the rear of a box van in which he was travelling as a passenger. The prosecution alleged that the individuals had no valid entry clearance to the UK and sought to link our client to the circumstances of their transportation.

It was alleged that our client had responsibility for items within the vehicle and that there were suspicious circumstances surrounding the journey.

Our Strategic Defence Approach

From the earliest stage, our defence team conducted a meticulous and forensic review of the prosecution material. This included detailed examination of Border Force witness statements, digital extraction evidence from mobile devices, travel history records, and exhibits said to connect our client to the journey.

We carefully scrutinised every aspect of the case to identify evidential weaknesses. Our analysis highlighted significant gaps in the prosecution’s ability to establish knowledge and intent. We examined issues surrounding digital interpretation and translation, challenged assumptions drawn from electronic material, and identified disclosure matters requiring close legal attention.

In serious immigration offence cases, digital evidence is often presented as compelling. However, context, translation accuracy, and proper evidential handling are critical. We ensured that all material was assessed rigorously and in line with the Criminal Procedure and Investigations Act obligations placed on the prosecution.

The case is overseen by Simon Jowett and Ornela Marku who instructed Caleb Suggitt  of 7 Harrington Street Chambers to represent our client in court.
