Sexual Assault Allegation Dropped Following Defence Representations
Being accused of a sexual offence can be devastating. Even before a case reaches trial, allegations alone can have a serious impact on a person’s reputation, employment, family life and mental wellbeing.
In this case, our client, who worked at Heathrow Airport, was charged with sexual assault following an allegation made by a fellow worker. The allegation was serious and carried the risk of a significant custodial sentence if he were convicted.
Following detailed preparation of the defence case and comprehensive representations made by Tank Jowett Solicitors, the Crown Prosecution Service ultimately offered no evidence, resulting in the proceedings being discontinued and our client avoiding a criminal conviction.
The Allegation
The allegation arose from an incident said to have occurred within the Wineglass Building at Heathrow Airport, where both parties were employed by different contractors working on site. The prosecution case relied primarily upon witness accounts, CCTV footage showing movements around the location, body-worn video footage and evidence of alleged redness to the complainant’s wrists.
Our client denied committing any criminal offence and maintained that he had not sexually assaulted the complainant.
Tank Jowett’s Defence
Our client initially received legal advice through the Duty Solicitor scheme but subsequently instructed Tank Jowett Solicitors to represent him due to our experience in defending serious and complex criminal allegations.
Our team carefully reviewed the prosecution evidence, including witness statements, CCTV evidence and the wider circumstances of the allegation. Following a detailed analysis of the case, we prepared a robust defence statement and made comprehensive written representations to the Crown Prosecution Service.
Throughout the proceedings, we remained focused on identifying evidential weaknesses and ensuring that all relevant matters were brought to the attention of the prosecution.
As a result of those representations and the ongoing review of the evidence, the prosecution ultimately decided not to proceed with the case.
Proceedings Discontinued
The Crown offered no evidence and the case was discontinued.
This brought the criminal proceedings to an end and meant that our client avoided the prospect of a trial, a criminal conviction and the severe consequences that can follow allegations of this nature.
Most importantly, our client was able to retain his employment and continue with his life without the uncertainty of ongoing criminal proceedings.
The defence was led by Partner Adnan Hussain and Solicitor Golnaz Tabaei, with Olivia Chessell of 2 Dr Johnsons Chambers instructed as counsel to represent the client before the court.
The Importance of Specialist Legal Representation
Allegations of sexual assault are among the most serious offences investigated by the police and prosecuted by the courts. A conviction can result in imprisonment, registration on the Sex Offenders Register and long-lasting consequences for employment and reputation.
Early legal advice and a carefully prepared defence can be crucial in ensuring that the evidence is properly scrutinised and that any weaknesses in the prosecution case are identified at the earliest opportunity.
