No Further Action Following Detailed Pre-Charge Representations

Being arrested on suspicion of involvement in a large-scale drug supply operation can have life-changing consequences. Allegations of conspiracy to supply controlled drugs frequently result in lengthy investigations, phone examinations, searches of residential properties and the risk of substantial custodial sentences.

In this case, our client was investigated on suspicion of conspiracy to produce and supply Class B drugs following his arrest and the discovery of cannabis-related items during police enquiries. Following extensive pre-charge work undertaken by Tank Jowett Solicitors, the case was ultimately discontinued and no charges were brought against our client.

The Allegation

During the search, police located cannabis plant material and hydroponic equipment. Further enquiries led officers to search a residential address where a number of items were recovered, including scales and vacuum-seal packaging containing cannabis residue.

The police investigation focused on allegations that our client was involved in the production and supply of controlled drugs and sought to link him to a wider operation.

Our client maintained that he was not involved in any conspiracy to supply drugs. Significant issues arose regarding occupation and control of the address concerned.

The police also examined mobile phone data and placed our client on bail whilst further enquiries were conducted.

Tank Jowett’s Defence

Following his arrest, our client instructed Tank Jowett Solicitors to represent him during the investigation.

Our legal team immediately began analysing the evidence relied upon by the police and carefully examined the alleged links between our client and the items recovered during the searches.

We made detailed pre-charge representations addressing a number of evidential weaknesses within the case and highlighting the lack of evidence capable of proving that our client was involved in a conspiracy to supply controlled drugs.

Particular attention was given to the issues of ownership, occupation and control of the address, together with the absence of evidence establishing that our client was directing, organising or participating in any drug supply operation.

Throughout the investigation, we remained in regular contact with the police and prosecution authorities, ensuring that all relevant matters were properly considered before any charging decision was made.

No Further Action

Following a review of the evidence and the representations submitted by Tank Jowett Solicitors, the authorities decided not to prosecute our client.

As a result, our client avoided being charged with serious drug offences that could have carried significant custodial penalties if proved.

The case was brought to an end at the pre-charge stage, sparing our client the stress, uncertainty and reputational damage associated with lengthy criminal proceedings.

The defence team was led by Partner Adnan Hussain and Solicitor Ornela Marku.
