Tank Jowett Solicitors have successfully secured the discontinuance of an assault prosecution brought against a Transport for London (TfL) employee.
Our client, a long-serving TfL Revenue Inspector of previous good character, faced a criminal allegation arising from an incident that occurred whilst carrying out her duties at a London Underground station. The allegation had the potential to have serious consequences not only for her personal reputation but also for her continued employment and future career prospects.
Following a detailed review of the prosecution evidence, the defence prepared and served a comprehensive Defence Case Statement setting out the factual and legal issues in dispute. The Defence Case Statement highlighted significant weaknesses in the prosecution case, challenged the reliability of the allegations being made, and identified a number of important lines of enquiry and disclosure issues which required investigation.
Following consideration of the Defence Case Statement, the prosecution discontinued the proceedings against our client.
This result was particularly important because our client worked in a position of public trust. The discontinuance of the case enabled her to continue her employment, preserve her excellent character, and avoid the significant personal and professional consequences that can follow criminal proceedings.
