Tank Jowett Solicitors has been instructed to represent a defendant charged in connection with a fatal dog attack alleged to have occurred at a property in Harrow. The case involves allegations under the Dangerous Dogs Act 1991 as well as offences under the Animal Welfare Act 2006.
The prosecution alleges that two dogs were dangerously out of control and caused injuries which resulted in the death of a visitor to the property. Following an extensive police investigation, charges have now been brought and the matter is progressing through the criminal courts.
The case is expected to involve detailed consideration of emergency call recordings, witness evidence, CCTV footage, veterinary assessments, forensic enquiries and expert medical evidence. As is often the case in serious prosecutions involving dogs, the court will need to consider a range of complex issues concerning ownership, responsibility, control of the animals and the circumstances surrounding the incident.
Dangerous dog prosecutions are among the most serious cases brought under animal-related legislation in England and Wales. Where a death has occurred, the consequences can be significant and the legal issues are frequently complex. Every case requires a careful examination of the evidence and the prosecution must prove the allegations beyond reasonable doubt.
As with all criminal proceedings, the defendant is entitled to the presumption of innocence and the allegations remain before the courts. Tank Jowett Solicitors has been instructed to provide specialist criminal defence representation and will be reviewing the evidence in detail as the case progresses.
The defence is being led by Partner Adnan Hussain and Solicitor Golnaz Tabaei, with Peter Guest of 187 Chambers instructed as counsel to represent the client before the court.
